ABA practice sick leave, family leave, and return-to-work requirements in Nevada include paid leave at covered 50-employee practices, family use of offered sick time, safety leave, school-participation time, pregnancy accommodation, federal family and disability law, military service, and workers' compensation. Owners should connect headcount, tenure, reason, pay, confidential documentation, client coverage, medical capacity, and restoration without reducing every absence to a PTO code.

Nevada leave changes when the practice reaches fifty employees

Nevada's paid-leave statute generally requires a private employer with 50 or more Nevada employees to provide at least 0.01923 hours of paid leave for each hour worked. The employer can frontload or accrue the benefit, may limit annual use and carryover to 40 hours, and must show the available balance on each payday.

A growing ABA practice should test the threshold before the fiftieth employee starts, not after the first request. Confirm who counts, which workers are temporary, seasonal, or on call, whether the first-two-years exception applies, and whether an existing PTO policy satisfies the statutory alternative. Put the conclusion and review date in the payroll record.

Covered employees can use Nevada paid leave after ninety days

The state rule permits use beginning on the 90th calendar day of employment. It reaches illness, diagnosis, treatment, preventive care, caregiving, and other personal health needs, and the employee can use available time without giving the employer a reason. Notice is due as soon as practicable.

That no-reason principle should shape the intake form. Ask for dates, expected duration, and operational information, not a diagnosis for ordinary paid leave. A separate protected-leave or accommodation request may require different evidence, but the scheduler should not make every sick day a medical investigation.

A smaller Nevada practice still has a policy to administer

Below 50 employees, or during a qualifying statutory exception, a company may still promise PTO, sick time, or another benefit. The handbook, offer letter, payroll settings, and repeated practice should agree about accrual, use, increments, carryover, payout, rehire, and corrections.

Do not describe a voluntary benefit as disposable. Employees plan care and family responsibilities around written promises. Managers need one escalation route when the policy intersects with FMLA, pregnancy, disability, domestic violence or sexual assault, school participation, military duty, or a work injury.

Nevada protects family use when an employer offers sick leave

The same Nevada leave chapter says that when an employer provides paid or unpaid sick leave, employees generally must be allowed to use accrued time to assist an immediate family member with an illness, injury, medical appointment, or other authorized medical need on the same conditions that apply to their own use. The employer can apply the statute's bounded usage limit.

Review relationship definitions and actual policy language rather than relying on a supervisor's idea of close family. Keep any health details restricted. The service team needs dates and coverage decisions, not the relative's diagnosis.

Safety leave has a separate 160-hour framework

An employee employed for at least 90 days who is a victim of domestic violence or sexual assault, or whose family or household member is a victim, may qualify for up to 160 hours within the 12 months after the act under Nevada law. The leave may be paid or unpaid and used consecutively or intermittently for listed care, assistance, court, or safety-planning purposes.

After the initial urgent use, the statute addresses advance notice for additional time and permits specified supporting documentation while requiring confidentiality. Build a private route that does not force the employee to retell the event to scheduling. Safety accommodations such as a transfer, changed schedule, or contact change require their own prompt review.

Required Nevada notices are part of the operating system

Nevada's employer-poster page maintains the paid-leave and domestic-violence or sexual-assault leave bulletins along with other current notices. A field-based practice should not assume that a poster in a locked administrative office reaches technicians who rarely visit it.

Post where required, then provide a controlled digital copy during onboarding and when the policy changes. Record the version and distribution. A notice does not replace a manager who knows where to route a request without asking intrusive questions.

Pregnancy accommodation can preserve work instead of forcing leave

The Nevada Pregnant Workers Fairness Act calls for a timely, good-faith interactive process after an employee requests an accommodation for pregnancy, childbirth, or a related condition. Possible changes include revised breaks, seating, light duty, a temporary transfer, position restructuring, and a modified schedule.

Nevada also prohibits forcing pregnancy leave when a reasonable accommodation would allow continued work and addresses reinstatement to the same or an equivalent role. For an ABA job, discuss driving, stairs, floor work, lifting, hydration, restrooms, session length, and documentation against the employee's actual limitation.

Federal rules may provide additional pregnancy or disability protection

Federal PWFA guidance and the EEOC ADA guide use their own coverage, definition, accommodation, and undue-hardship standards. A worker's Nevada right, federal right, and voluntary company support may overlap without being interchangeable.

Document one respectful dialogue with separate conclusions. Payer authorization and family preference influence client assignments, but they do not determine the employment accommodation. Clinical leadership should receive the approved limits, not the underlying medical narrative.

School participation creates a narrow leave right at larger employers

Nevada's school-participation statute generally requires an employer meeting its 50-employee and 20-week definition to provide a parent, guardian, or custodian four hours per school year for each child in public school for listed conferences, activities, volunteering, or events. Time is taken in at least one-hour increments at a mutually agreed time and need not be paid.

The law permits a written request at least five school days ahead and attendance documentation. Build this route beside ordinary PTO so the supervisor does not call it an unexcused absence. An emergency school contact has related anti-retaliation protection and may not fit the advance-request process.

FMLA is a federal clock, not a label for every Nevada absence

Federal FMLA Fact Sheet 28 explains the employer and employee tests for job-protected serious-health, caregiving, bonding, and military-family leave. Headcount, tenure, 1,250 hours, worksite, reason, notice, and certification all matter.

When FMLA and Nevada safety leave cover the same reason, Nevada law addresses concurrent deduction. Other paid leave, pregnancy, school, or workers' compensation questions may have different coordination rules. Use one calendar that identifies the authority and pay source behind each date instead of one generic leave balance.

Military absence should not disappear into unlimited unpaid time

Federal USERRA guidance protects qualifying service and reemployment at employers of every size. The analysis reaches notice, cumulative service, benefit elections, the correct returning position, missed advancement, qualification efforts, and retaliation.

Keep the service record with the employee's prior duties, pay, training, and caseload status. Reassigning clients can be essential during an absence, but it does not erase reemployment obligations. Explain the distinction to both operations and clinical leaders.

Workers' compensation begins before a Nevada practice feels large

Nevada's Workers' Compensation Section maintains current employer, injured-worker, claim, medical, benefit, and form resources. Nevada generally requires coverage when a business has one or more employees unless a statutory exclusion fits, so confirm the policy and notices before field work starts.

Give workers a same-day incident route and access to the appropriate forms and authorized-care information. Capture the event, task, location, initial condition, witnesses, immediate care, lost time, and carrier transmission. Do not use a PTO code as a substitute for claim reporting.

Modified duty needs more than the words light work

Nevada's workers' compensation framework addresses temporary modified duty and temporary partial disability. A proposed return should be grounded in current medical restrictions and a factual job description rather than a supervisor's intuition about what seems easy.

Spell out the site, travel, stairs, floor position, lifting, rapid response, session duration, documentation, schedule, supervision, wage, duration, and next review. Compare the proposal with FMLA and accommodation duties. Useful work within restrictions is different from a nominal task designed only to change benefits.

Confidentiality and continuity can coexist

The coordinator may need statutory documentation, the carrier needs claim materials, payroll needs an approved code, and clinical leadership needs dates and restrictions. Separate those views. A family or unrelated coworker should not receive a diagnosis, pregnancy information, safety details, school records, military orders, or injury status.

A good family message still provides substance: name the contact, say whether qualified interim coverage exists, explain how treatment information will transfer, and give the next update date. If no safe and authorized replacement exists, acknowledge the temporary service gap rather than pressuring the absent employee.

A fictional Nevada practice shows how the thresholds meet

Silver Basin Behavior is a fictional ABA practice approaching 50 employees when one technician uses paid leave, another requests safety-related time, and a supervisor later returns from a work injury with shorter-driving restrictions. Headcount, tenure, reason, pay, evidence, and work capacity change the route for each event.

One coordinator maintains the legal and payroll timeline while the clinical team sees only coverage facts. Silver Basin Behavior is not a customer, formal determination, or guaranteed result; it is a composite that makes the operating distinctions easier to discuss.

Audit Nevada leave with a threshold and a real case

First verify the current Nevada headcount and first-two-years status, then select a recent absence. Trace accrual, eligibility, reason-free paid leave, family use, safety or school protection, federal screening, pregnancy or disability accommodation, claim reporting, restriction analysis, privacy, client handoff, and restoration.

Read every employee-facing message. It should say what is paid, what is protected, which evidence is needed, who may see it, what remains pending, and when the next response will arrive. If a correct answer is buried inside a maze of departments, the process is not yet dependable.
