Owners should keep pay, job protection, documentation, sensitive records, service coverage, restrictions, and restoration connected but distinct.

Arizona earned paid sick time applies even to very small practices

Arizona's earned paid sick time accrual statute requires one hour of accrual for every 30 hours worked. Employers with 15 or more employees may cap annual accrual and use at 40 hours, while employers with fewer than 15 may use a 24-hour cap unless they choose a higher limit.

That means the policy belongs in place with the first employee. Keep a dated headcount that includes full-time, part-time, and temporary workers under the statutory method. A clinic's number of active cases or credentialed clinicians does not answer the employee-count question.

The benefit begins accruing before many owners expect it

Arizona accrual starts when employment begins, although an employer may require a newly hired employee to wait until the 90th calendar day to use accrued time. Overtime-exempt employees are generally presumed to work 40 hours for accrual unless their normal workweek is shorter. The statute also addresses carryover, frontloading, transfers, rehiring within nine months, and successor employers.

Choose an accrual-year and configuration that preserve those rules, then explain them without payroll jargon. A variable schedule should not make the balance mysterious. Show employees what is available, what was used, and whom to contact when a worked hour or leave entry appears wrong.

Covered reasons include family care, public health, and safety needs

Arizona's use statute covers the employee's own health care, a family member's health care, specified public-health closures and exposure concerns, and needs connected to domestic violence, sexual violence, abuse, or stalking. The family and safety provisions are broader than a policy that only mentions personal illness.

Keep the initial conversation gentle and narrow. Ask for expected duration, affected work, and a safe way to follow up. Do not ask the employee to explain violence in a group chat or share a diagnosis with scheduling. The practice can arrange coverage without circulating the private reason.

Employees cannot be required to find their own substitute

Arizona expressly says an employer may not make replacement-finding a condition of earned paid sick time. In ABA care, employees may still know useful facts about family routines or qualified colleagues, but offering a handoff is different from carrying the employer's staffing burden.

Build a coverage pathway that reviews competence, supervisor capacity, geography, authorization, record access, and family preference. If no appropriate match exists, communicate the delay honestly. A protected absence should not become a loyalty test or a debt the employee must repay through extra sessions.

Notice and documentation have practical limits

Foreseeable sick time calls for a good-faith effort at advance notice. For unexpected needs, an employer that wants a notice procedure must give employees the written policy. Reasonable documentation may be requested after three or more consecutive workdays, with special choices and confidentiality protections for safety-related leave.

The first manager should acknowledge, record timing, route the request, and arrange immediate coverage. A restricted reviewer can handle documentation. Payroll receives hours and pay status; scheduling receives availability. This separation prevents an urgent request from becoming an unnecessary interrogation.

Pay statements and notices are part of the Arizona system

The Industrial Commission employer portal collects official sick-time, posting, wage, and claim resources. Arizona also requires written notice of rights and pay-statement information showing available sick time, time taken, and sick-time pay. A back-office balance that employees cannot see is not enough.

Audit a real pay statement and onboarding packet. Check that the legal employer name is correct, notices are available in required languages, the balance matches time records, and managers know where the current poster lives. Version changes so a later question can be answered from the policy then in effect.

FMLA may arrive before the practice feels large

Federal FMLA Fact Sheet 28 covers private employers with at least 50 employees in 20 workweeks and separately tests the employee's 12 months, 1,250 hours, and 50 workers within 75 miles. Mobile service makes worksite analysis less obvious than the address of the family receiving care.

Preserve the reporting location, assignment source, actual hours, tenure, leave year, notices, certifications, and any overlap with Arizona paid sick time. A state paid balance and federal job protection can run together, but each retains its own eligibility and documentation rules.

Pregnancy requests may be about work design rather than absence

A zero balance does not automatically close an ADA request

The EEOC small-business ADA guide explains that additional finite leave or a modified schedule may be a reasonable accommodation absent undue hardship. Arizona sick time, company PTO, and FMLA may all end on different dates, and none alone decides when employment must end.

Review expected duration, essential duties, possible adjustments, staffing impact, and current information. Revisit a temporary plan on a sensible date. A practice need not accept indefinite unpredictability in every case, but it should not let software turn an exhausted bank into an automatic denial.

Crime-victim leave has a separate threshold and confidentiality rule

Arizona's crime-victim leave statute applies to employers with 50 or more employees under its counting method and allows qualifying victims time for specified proceedings or protective relief. The law addresses documentation, unpaid status, use of accrued benefits, seniority, nondiscrimination, confidentiality, and possible undue hardship limits.

Do not merge this protection with sick and safe time without reviewing which rule applies. Store notices away from ordinary scheduling, share only the dates needed for coverage, and consult counsel before limiting leave. The employee's safety and the practice's legal analysis both deserve a private channel.

Voting and jury service should not be treated like ordinary PTO

Arizona's voting-leave statute provides paid time when the work schedule does not leave three consecutive hours around poll opening or closing and the employee applies before election day. The jury-service statute bars employers from forcing use of annual, vacation, or sick leave and protects service and return, although jury time need not be paid.

Record the request, schedule facts, summons or election timing, and the code used. A clinician with evening sessions may need coverage even when the daytime calendar appears open. Civic leave should not depend on the manager's enthusiasm or be deducted from the wrong bank.

Military service follows a protected reemployment route

Federal USERRA guidance supplies leave, benefit, seniority, nondiscrimination, and reemployment protections when its conditions are met. Paying Arizona sick time or company PTO does not replace that path, and assigning families elsewhere during service does not decide the returning employee's position.

Keep the service notice, dates, benefit election, role and pay history, training changes, and timely return request. Use temporary coverage language with families and staff. Seek qualified advice when the service period or discharge status creates uncertainty.

A practical Arizona audit begins with one real absence

Trace the initial message, sick-time eligibility, pay-statement balance, any FMLA or accommodation review, civic or victim protection, documentation, family coverage, payroll, injury restrictions, and return. Confirm that headcount, policy version, language access, and notice dates can be reconstructed from records rather than memory.

Then ask an employee where they would send an urgent request and ask a supervisor what they would say first. A strong answer is calm: receive the request, protect privacy, solve immediate coverage, and route the legal decision. That is more useful than a long policy nobody can use.
