A temporary accounting suspension is a required pause in an individual's right to receive an accounting of specified disclosures when a health oversight agency or law-enforcement official states that providing it would be reasonably likely to impede the agency's activities. A written statement sets the suspension period. An oral statement must be documented and lasts no more than 30 days unless a qualifying written statement arrives during that time.

The request must come from a defined authority

45 CFR 164.528 ties suspension to disclosures to a health oversight agency or law-enforcement official under the cited Privacy Rule pathways. Verify the requester, authority, affected disclosures, impediment statement, form, received time, and scope.

Route the statement immediately to the privacy or legal function authorized to validate it. Confirm the requester's agency, role, callback information, and relationship to the relevant oversight or law-enforcement activity using a trusted channel. Identify the disclosures covered by the statement and the reason an accounting would be reasonably likely to impede the activity. A general request for secrecy or an internal investigation label does not establish this specific suspension pathway.

Scope the hold narrowly. A statement may relate to a particular agency, recipient, event series, investigation, or period. Other accountings and unaffected entries should continue through the ordinary process. Store sensitive details in a restricted record while giving fulfillment staff enough instruction to apply the correct dates and entries.

Oral and written clocks differ

The HHS Audit Protocol restates the rule. For an oral statement, document the statement and the identity of the agency or official, begin the temporary suspension, and set an outer date no later than 30 days. A later written statement can specify another period under the rule.

For a written statement, preserve the period specified by the official and the signed or attributable communication. Record received time, effective start, end condition, affected disclosure population, and approving reviewer. Configure reminders before the stated period ends and require a new qualifying statement for any later period.

For an oral statement, contemporaneously document the official's identity, agency, content, affected disclosures, impediment representation, date, and time. Set automatic expiration no later than 30 days from the oral statement. A written statement received during that interval can establish the written period. In the absence of one, the special oral suspension ends at the 30-day limit.

Continue the case without exposing the hold

The accounting request still needs controlled case management. Collect and validate unaffected events, calculate the ordinary response deadline, and keep the suspended entries segregated. Privacy or legal leadership should determine how the suspension interacts with the response and communications in the specific case. Frontline staff should avoid revealing protected investigation details while following the approved instruction.

When the suspension ends, remove the hold, re-evaluate the affected entries, complete any remaining accounting work, and document the resumption date. Automatic expiry is a safeguard, not a substitute for case review. A system should alert the owner rather than silently releasing sensitive content or leaving the suspension in place indefinitely.

Example with suspension controls

Four suspension requests arrive. Three are written with defined periods; one is oral. The oral request is documented but lacks a 30-day stop date. Control completeness is 3 of 4 requests until the stop date is set.

Suppose that oral statement covers two law-enforcement disclosures in one individual's otherwise complete accounting. The practice validates the official, records the call on August 1, and sets expiration for August 31. On August 20, a qualifying written statement specifies a period ending October 15. The ledger preserves both statements, updates only the two affected entries, alerts the owner before October 15, and shows when normal processing resumes.

Suspension checklist

  • Verify that the statement comes from a qualifying health oversight or law-enforcement official.
  • Confirm the statement says an accounting would be reasonably likely to impede the activity.
  • Identify the affected disclosures and limit the suspension to that scope.
  • For a written statement, record the specified period and attributable source.
  • When the statement is oral, document the call and set an outer date no later than 30 days.
  • Restrict investigation details while continuing unaffected accounting work.
  • Alert the case owner before expiry and require support for any later period.
  • Resume, reconcile, and document processing when the suspension ends.

Owner controls

Limit the hold to the specified accounting content, restrict access to sensitive investigation details, assign legal or privacy review, create an automatic expiration, and resume processing when the suspension ends. Preserve the request and every change to its period.

Audit active suspensions for verified authority, exact scope, written or oral basis, expiration, and current owner. Track expired holds, oral statements awaiting written follow-up, extensions without supporting statements, and cases that failed to resume. Access logs should show who viewed or changed the restricted record.
