Relevant NPP selection is the health plan's choice of the notice that applies to the individual or other person requesting it when the plan maintains more than one Notice of Privacy Practices. Selection should use current product, entity, population, effective-date, and request facts. A general notice library can support access, while the plan still needs a reliable way to identify and provide the relevant version.

More than one notice requires a decision rule

45 CFR 164.520 allows a health plan with multiple notices to meet the provision requirement by supplying the relevant notice. Build a versioned mapping from plan and product facts to the approved notice instead of asking staff to choose from filenames.

Create a notice inventory with legal entity, plan, product, employer or individual market where relevant, jurisdiction, population, effective start and end, language, accessible format, Part 2 or other special scope, public location, and archive location. Give every notice a durable version identifier. Retired notices remain searchable for historical questions but unavailable to current automated selection.

Use a reproducible decision table

Translate applicability into ordered fields and exceptions. Start with the person or policy and coverage period, then resolve entity, plan, product, jurisdiction, and any special record or population scope. Return the current notice, one or more historical notices for multiple periods, or a trained-review state. Record the inputs, result, rule version, time, and owner.

Test edge cases before release: product transfer, overlapping coverage, retroactive eligibility, employer change, merger, brand alias, dependent addition, state move, and a request that spans two effective periods. A simple current-plan lookup can give the wrong answer for a historical privacy question.

Requesters may supply incomplete facts

Use a short clarification path for product, coverage period, employer group, jurisdiction, or relationship when needed. Collect only decision-relevant information. If ambiguity remains, route it to a trained owner and explain how the requester can receive available notices.

Do not require detailed health information, a diagnosis, or a reason for seeking a public notice. Use enrollment identifiers or nonclinical plan facts only where needed to select the relevant document. If identity verification is unnecessary for public notice provision, avoid creating that barrier. A separate rights request may have its own verification requirements.

When two notices could reasonably apply, provide a qualified explanation or both relevant notices while the mapping owner resolves the rule. Preserve the request date and safe delivery preference. Do not close an ambiguity by choosing the newest file automatically.

Govern changes as mapping releases

Any new notice, product, state, entity, effective date, merger, or archive action should trigger mapping review. Use test cases with expected results and compare production output before release. Track unmatched and multi-match cases, investigate changes in their rate, and maintain a rollback path for bad rules. Content approval and selection approval are separate gates.

Example with mapping results

Twenty-eight requests reach a defined review date. Twenty-four map to one notice, three require two relevant notices because periods changed, and one lacks enough information after accessible outreach. Selection completion is 27 of 28 requests; documents delivered are 30 notices, a different unit.

The owner preserves the unresolved request, offers the available notice library, and records the missing decision facts. It tests whether the gap came from the request, enrollment data, or mapping table. The three multi-period requests remain correctly counted as three completed requests and six delivered notices.

Relevant-notice checklist

  • Inventory every notice with entity, product, jurisdiction, and effective period.
  • Use durable versions and separate current from archived copies.
  • Apply a tested, ordered selection rule with recorded inputs.
  • Handle transfers, overlaps, retroactivity, and historical periods.
  • Collect only the nonclinical facts needed for selection.
  • Preserve unresolved or multi-match cases for trained review.
  • Test mapping changes and audit production results.

Owner controls

Use HHS model notices for current content structure. Maintain the notice inventory, applicability fields, effective periods, decision owner, requester instructions, test cases, unmapped queue, and quarterly mapping review.

Monitor requests completed, notices delivered, unmatched cases, multi-match cases, wrong-version findings, archive leaks, and rule changes. Audit from actual requests into the selected notice and from each active notice into the population it should serve. Preserve mapping versions and test evidence so a later reviewer can reproduce the decision.

Use production reconciliation to find silent gaps. Compare the full product and entity inventory with mapping keys, then inspect whether every active combination returns one expected current notice. Review combinations with zero recent selections because they may indicate a dormant product or a missing rule. Compare historical period queries with the archive index.

Assign every ambiguous or wrong selection an affected-period review. Correct the rule, identify requests or deliveries that used it, provide the relevant notice where appropriate, and preserve the original result. Do not delete bad selections from reporting once the requester receives a correction.
