The NPP paper copy right lets an individual obtain a paper Notice of Privacy Practices from a covered entity upon request, including after agreeing to receive the notice electronically or receiving it that way. The paper copy should be the version currently in effect and reach the person through a usable, safe route. The request does not require withdrawal of the individual's electronic-notice agreement.

Electronic notice preserves the paper option

Current 45 CFR 164.520 states that recipients of electronic notice retain the right to a paper copy. Record request date, requester and authority when applicable, current version, language or accessible format needs, delivery method, address, sent date, and completion.

Accept requests through ordinary privacy, front-desk, phone, portal, mail, and service channels. Staff should recognize a simple request without requiring the person to cite HIPAA or explain why paper is preferred. Verify identity and representative authority reasonably while avoiding unnecessary friction.

Keep the electronic-notice agreement in place unless the individual separately changes it. A paper request can coexist with electronic delivery and does not need a new portal enrollment or electronic withdrawal.

Offer practical fulfillment routes

A person may pick up a copy, receive it by mail, or use another approved paper route. Check confidential-communication instructions before sending. Avoid requiring a new portal enrollment, reason, or electronic-consent withdrawal as a condition of the paper request.

Confirm the current version, correct covered entity, appropriate language, and any accessible format. For pickup, define location and availability. For mail, verify a safe destination without using a route the person marked unsafe. Preserve paper-send, pickup, delivery, return, or replacement evidence.

Control print versions and stock

Use one approved print source with version and effective date. Remove obsolete handouts from sites, intake packets, vendors, and stored print jobs after revision. Inspect print quality, page order, font size, headers, and missing pages before fulfillment.

Track returned mail and incorrect versions as open defects. Send a current replacement promptly and assess whether other copies from the same stock or batch were affected. Keep paper-copy fulfillment separate from first-service delivery and acknowledgment metrics.

Example across requests

Seven paper-copy requests reach their target date. Six are fulfilled with the current version; one receives an obsolete notice. Accurate completion is 6 of 7 requests. The obsolete delivery needs replacement.

If one mailed copy later returns, final supported fulfillment drops until a safe replacement route is resolved. Requested, sent, current, delivered, and returned are different states. Keep the denominator at seven requests.

  • Verify requester, authority, correct entity, and current version.
  • Preserve the separate electronic-notice agreement unless changed.
  • Check language, accessibility, and confidential-contact needs.
  • Use controlled print files and remove obsolete stock.

  • Audit inventory and batches after every material revision.

Monitor requests, current-version fulfillment, returns, replacements, aging, and stock findings. Mystery-shop front desk and phone routes. Test continuity during printer, vendor, mail, or portal outages so the paper right remains practical.

Create one request record from intake to final disposition. Include requester, authority, entity, version, language, accessible format, safe destination, selected fulfillment method, due owner, sent or pickup time, return, replacement, and closure evidence. Avoid collecting a reason for the request. Route questions about another entity's notice to a helpful contact rather than giving an unrelated document simply to close the ticket.

Audit both central and local stock. Compare approved source checksums or version identifiers with print-room files, site handouts, intake packets, and vendor inventories. Inspect preassembled folders and forms stored offsite. When an obsolete copy is found, define the affected batch and replace known deliveries where appropriate. Track waste and stock only as operational measures; availability and accuracy remain the compliance outcomes. Keep paper-copy requests separate from the physical-site take-away inventory.

Make the request route easy to discover for people who primarily use electronic services. The online notice, portal, phone script, and privacy contact should explain how to obtain paper without requiring portal access or a detailed justification. Test the route with a realistic request, including a language or accessible-format need, and measure whether staff select the correct entity and current version. If mailing is returned, preserve the event and use an approved, safe correction process. Never substitute an emailed attachment simply because paper fulfillment is inconvenient.

For pickup, define how long the copy remains available, how identity or representative authority is checked, what happens when it is not collected, and how the requester can choose another safe delivery method. Close the record only with a supported disposition.
