A health plan website notice revision is the distribution route for a health plan that posts its Notice of Privacy Practices on a qualifying website. By the material change's effective date, the plan prominently posts the change or revised notice online. In its next annual mailing to covered individuals, it provides the revised notice or explains the change and how to obtain the revision.

The route has two required steps

Current 45 CFR 164.520 ties the online step to the effective date and the member step to the next annual mailing. A website release alone leaves the annual-mailing action open. A mailing alone can miss the effective-date publication gate.

Track the two steps as related obligations with separate owners and evidence. The effective-date record should include legal approval, revised notice or change summary, qualifying website, publication time, prominence and accessibility test, version, and captured artifact. The annual-mailing record should identify the qualifying communication, covered-individual cohort, approved insert or notice, vendor file, send evidence, failures, and completion owner.

Confirm that the website route fits the plan

Document that the health plan maintains a website providing customer-service or benefit information and identify every domain, product, brand, and language experience where the notice should appear. Test discovery from home, benefits, member service, contact, forms, and search routes. Verify mobile and assistive-technology access, current plan identity, effective date, and downloadable format. Authentication or enrollment should not unexpectedly block the route selected for public notice availability.

Inventory acquired brands, third-party administrators, member portals, and vendor-hosted benefit sites before launch. Contract ownership can assign deployment work, while the plan still needs reproducible evidence that the intended notice was prominently available by the effective date.

Qualifying website and mailing need owners

Confirm that the plan maintains a website providing information about customer services or benefits and posts the notice prominently there. Define which communication is the next annual mailing, who owns its content, which covered-member cohort it reaches, and how fulfillment evidence is retained.

Lock the mailing event and cohort through a documented rule. Identify the next annual mailing to covered individuals, its expected date, source enrollment system, representative or named-insured handling, duplicate rules, safe-address controls, print and electronic channels where approved, and evidence returned by vendors. A general marketing campaign should not be chosen merely because it is convenient.

Reconcile enrollment changes, product overlap, deceased members, representatives, undeliverable addresses, and retroactive records without silently changing the denominator. Preserve the original cohort plus supported adjustments. Confirm that the mailing either provides the revised notice or describes the material change and explains how to obtain the revised notice, as applicable to the route.

Keep failures and delayed annual mailings visible

Website availability does not close paper returns, failed electronic deliveries, missing vendor records, or members omitted from the annual mailing. Create an exception queue with reason, owner, next action, and supported final state. Monitor the website through the interval before mailing so the route stays current and available. If the annual communication is replaced or delayed, qualified owners should identify the next valid event and preserve the decision.

During a vendor change, retrieve recipient-level send and failure evidence before access ends. A revised notice goes live on the effective date. The next annual mailing is due to 14,200 covered individuals and reaches 14,050. Website timeliness is 1 of 1 required publication events; annual-mailing delivery is 14,050 of 14,200 recipients. Keep the 150 failed or undelivered records visible for follow-up.

The plan categorizes the 150 exceptions, validates safe addresses through approved sources, retries the permitted routes, and records final dispositions. It also compares the website checksum with the approved version and confirms continued availability. The annual step closes only when the fixed cohort, sends, failures, adjustments, and unresolved cases reconcile.

  • Publish prominently and test discovery and accessibility by that date.
  • Define the next annual mailing and lock the covered cohort.

Re-test after product, website, enrollment, vendor, branding, legal, or communication changes.
